TERMS OF USE AGREEMENT (Nov 19, 2022)

Please read the following Terms and Conditions of Use ("Terms") carefully before using the Portal. These Terms govern your use of this application.

1. The Zing Health App services are offered to you under the terms and conditions contained within this TERMS OF USE AGREEMENT. The Zing Health App services are only available to individuals with a valid email address and they must be either a registered patient or planning to register as a patient of E.M.S. Memorial Co-operative Hospital & Research Centre. The Zing Health App reserves the right to modify or change any of the terms of this Agreement at any time and for any reason. The Zing Health App will promptly post any modifications or changes to this Agreement on the website. Your continued use constitutes your consent to be bound by any such modifications or changes to this Agreement, and it is your obligation to periodically visit this page of the website and review the latest version of the Agreement. The date of the last update to this Terms of Use Agreement will be stated at the top of this page.

2. Use of Services

NOT FOR EMERGENCIES. The Zing Health App services are not for use in medical emergencies or urgent situations or time sensitive material. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR IMMEDIATELY.

Cost: There is a minimal charge for online registration and appointment booking. No charge for using other services of the Zing Health App like linking Patient Identification Number, viewing Lab Results and Medications.

Your Account: You represent and warrant that you possess the legal right and ability to enter into this Terms of Use Agreement, register on the Zing Health App under your own name and to use these services in accordance with this Agreement and abide by the obligations hereunder. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your password. You agree to prohibit anyone else from using your password and immediately notify Zing Health App of any unauthorized use of your password or other security concerns of which you became aware. The Zing Health App is not responsible for breaches of confidentiality caused by you or an independent third party.

3. Privacy

The Zing Health App respects your privacy and takes privacy very seriously. By entering into this Terms of Use Agreement, you consent to the use and disclosure to you of personally identifiable information provided to us as outlined in our Privacy Practices.

Zing Health App Medical Record: Your medical record is created to store some of your personal health information online and may include information concerning your health conditions, allergies and medications.

4. General Legal Provisions

Operation and Record Retention:The Zing Health App reserves complete and sole discretion with respect to the operation of the Health App services. The Zing Health App may, among other things withdraw, suspend or discontinue any functionality or feature of the Health App services. The Zing Health App is not responsible for transmission errors and corruption or compromise of data carried over local or interchange telecommunication carriers. The Zing Health App is not responsible for maintaining data arising from use of the Health App services. The Zing Health App reserves the right to maintain, delete or destroy all communications and material posted or uploaded to Health App services pursuant to its internal record retention and/or destruction policies.

Limitations on Use: By entering into this Agreement, you agree not to attempt to access any other patients medical records or use the Health App in an unlawful way or for any unlawful purpose. You shall send secure, electronic messages to other parties solely for personal communication and no other purposes, including commercial purposes, or for mass distributions of unsolicited e-mails. You agree not to post or transmit: (a) a message under a false name; or (b) any information which (i) is libellous, defamatory, obscene, fraudulent, false or contrary to the ownership or intellectual property rights of any other person, or (ii) contains any virus, work, Trojan horse or other code which is contaminating or destructive to the files or programs of the Zing Health App or any of its users. The Zing Health App reserves the right to delete any information provided by you that it deems in its sole discretion fraudulent, abusive, defamatory, obscene, or in violation of a copyright or other intellectual property right.

Proprietary Rights: You acknowledge and agree that the Zing Health App contains proprietary and confidential information that is protected by applicable intellectual property and other laws. The Zing Health App is the owner or licensee of all rights in the Portal, its content, software, and services. You have no rights to such content, software or services except as expressly granted in these Terms. " Zing Health App" and the logos or other proprietary marks of Zing Health App licensors and partners are trademarks of Zing Health App or its licensors and partners. No right, title or interest in those trademarks is granted to you in these Terms.

All the information displayed, transmitted or carried by Zing Health App website including, but not limited to, text, photographs, images, illustrations, profiles, trademarks, service marks and the like, collectively the "Content", are protected by the copyright and other intellectual property laws and be informed that the content of the same is not intended to be a substitute for professional medical advice and not for solicitation of business. The Content is owned by Zing Health App, its affiliates or third party licensors. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display or in any way commercially exploit any of the Content. You agree to abide by all copyright notices and restrictions attached to any Content accessed through the Zing Health App website and not to alter the Content in any way. Permitted Use you may take a single copy of the Content displayed on the Zing Health App for personal, non-commercial use only, provided that you do not remove any trademarks, copyright and any other notice contained in such Content. You shall not archive or retain any Content in any form. The information provided in this site for the sole purpose of disseminating health information for public benefit.

Links: The Zing Health App is Not Responsible For Any Links To or From Other Sites. This Portal may contain links to other Web sites, and other Web sites may provide links to this Portal. These links are provided for your convenience only. The Zing Health App does not control these other sites and assumes no liability or responsibility for them, including any content or services provided to you by such sites. You should not consider any link to or from another site as an endorsement of that site by Zing Health App.

FURTHER, Zing Health App DISCLAIMS ANY WARRANTY THAT THE PORTAL WILL BE AVAILABLE AT ALL TIMES OR WILL OPERATE WITHOUT INTERRUPTION OR ERROR. Zing Health App MAKES NO WARRANTY AS TO THE RELIABILITY, ACCURACY, TIMELINESS, USEFULNESS, ADEQUACY, COMPLETENESS OR SUITABILITY OF THE SERVICES OR INFORMATION PROVIDED THROUGH THE PORTAL.

Indemnity: YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS Zing Health App ITS EMPLOYEES, AGENTS AND ITS AFFILIATED ENTITIES FROM ANY LOSSES, LIABILITY, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEYS FEES, ARISING OUT OF OR RELATED TO ANY BREACH OF THIS TERMS OF USE OR ANY NEGLIGENT OR WRONGFUL USE OF THE PATIENT PORTAL SERVICES BY YOU OR ANY OTHER PERSON ACCESSING YOUR ACCOUNT.

Term and Termination: This Terms of Agreement shall commence upon the date you first access or use the Zing Health App services and/or complete the registration process. The Zing Health App may terminate this Agreement and your right to use the Health App services anytime, with or without cause. This Agreement and the rights granted hereunder terminate without notice in the event you (or any authorized person using your account) fail to comply with the terms and conditions of this Agreement, or the rules for use of the Health App.
